1. Purpose and scope
These general conditions apply to any provision of a vehicle with chauffeur by Nerion SA, Chemin de la Péraulaz 34, 1093 La Conversion (UID CHE-146.932.021). Any request submitted through the site implies acceptance of these conditions. They prevail over any conflicting condition of the client, unless otherwise agreed in writing by Nerion SA.
2. Estimate and formation of the contract
The amount displayed by the site's calculator is an estimate based on the information entered by the client and on the automatically computed road route. This estimate is neither a firm offer, nor a booking, nor a confirmation of availability. The contract is formed only upon express confirmation by Nerion SA, sent to the client in writing after verification of vehicle and chauffeur availability. Nerion SA reserves the right to decline a request without stating reasons.
3. Prices and services included
Prices are stated in Swiss francs, all taxes included. A direct transfer covers the pickup fee and the kilometres of the road route. Packages for a chauffeur at disposal cover the pickup fee together with the stated duration and mileage; the better-value package is applied automatically. Any time beyond the package is billed pro rata, as is any kilometre beyond what the package includes. The mileage applied is that of the actual road route, stops included, rounded up to the next kilometre.
4. Costs not included
Tolls, road vignettes, parking charges, airport fees and similar costs are not included in the estimate. They are notified to the client before the journey where foreseeable, then billed at cost afterwards. Any additional service requested during the journey (an unplanned stop, an extension, a change of destination) is billed additionally at the applicable rates.
5. Payment
The site processes no payment. Payment terms are communicated to the client when the service is confirmed. Unless otherwise agreed, invoices are payable within thirty days of their issue date. In the event of late payment, default interest of 5% per annum is due from the due date without prior reminder, recovery costs remaining reserved.
6. Cancellation by the client
Any cancellation must be communicated in writing. It is free of charge when made more than 48 hours before the agreed pickup time. It gives rise to a charge of 50% of the confirmed amount when made between 48 and 24 hours before pickup, and of 100% when made less than 24 hours before. These periods are counted in full hours before the agreed pickup time.
7. Client no-show
A client who does not appear at the agreed pickup location within the waiting times set out in article 8, without having cancelled, is deemed absent. A no-show results in the full confirmed amount being charged, plus any costs actually incurred.
8. Waiting time
Fifteen minutes of waiting time are included for any pickup at an ordinary address. For a pickup at an airport or a station, this is extended to sixty minutes and runs from the actual arrival time of the flight or train, provided the flight or train number was communicated. Beyond that, waiting time is billed at the applicable hourly rate, pro rata.
9. Changes to the service
Any change request must be submitted in writing and takes effect only once confirmed by Nerion SA, subject to availability. A substantial change to the route, the duration or the vehicle gives rise to a new price calculation. A change requested less than 24 hours before pickup may be treated as a cancellation followed by a new request.
10. Cancellation by Nerion SA
Nerion SA may cancel a service in the event of force majeure, an unforeseeable event beyond its control, or an impediment affecting the vehicle or the chauffeur. It will then endeavour to offer a replacement vehicle or an alternative time. Failing that, any amounts already paid are refunded in full, to the exclusion of any other compensation.
11. Client obligations
The client provides accurate and complete information, in particular addresses, times, the number of passengers and the volume of luggage. The client is responsible for the accuracy of information provided on behalf of third parties. The client follows the chauffeur's instructions regarding safety and seat belts.
12. Rules on board
Passengers and luggage are carried within the capacities stated for each vehicle. Smoking and vaping on board are prohibited. Carriage of animals is subject to prior agreement. Child seats are provided on request made at the time of the order. The chauffeur may refuse to carry a passenger whose behaviour compromises safety, or end the journey for the same reason, the price remaining due in full.
13. Liability
Nerion SA is liable for damage caused by its fault in accordance with Swiss law. Its liability for delays resulting from circumstances beyond its control, in particular traffic conditions, weather conditions or measures taken by the authorities, is excluded to the extent permitted by law. Any liability for indirect damage or loss of profit, in particular a missed connection, is excluded to the extent permitted by law. Clients are advised to allow a sufficient time margin for any journey connected with a flight or a train.
14. Belongings and luggage
Luggage and personal belongings remain in the client's custody. Nerion SA accepts no liability for valuables left unattended on board. Lost property is kept and returned on request.
15. Data protection
Data submitted with a request is processed by Nerion SA solely to handle that request, perform the service and issue invoices. It is neither sold nor passed to third parties for advertising purposes. Processing is governed by the Swiss Federal Act on Data Protection. Clients may access, correct and delete their data by writing to info@nerion.ch.
16. Complaints
Any complaint relating to a service must be sent in writing to info@nerion.ch within thirty days of that service. Nerion SA acknowledges receipt and responds within a reasonable period.
17. Amendment of these conditions
Nerion SA may amend these conditions at any time. The applicable version is the one in force on the day the service is confirmed.
18. Applicable law and jurisdiction
These conditions are governed by Swiss law, excluding its conflict-of-law rules. The exclusive place of jurisdiction is Lutry, subject to any mandatory jurisdiction provided by law and to appeal to the Federal Supreme Court.
